What is Standard Contractual Clauses (SCCs)?

Standard Contractual Clauses, known as SCCs, are official contract templates issued by Chinese authorities for cross border personal data transfers.

 

Companies transferring personal information abroad can sign these clauses with overseas recipients instead of applying for a full security assessment in certain cases. The clauses define obligations of both parties, including data protection standards and liability. Businesses must also file the signed contract with authorities and conduct impact assessments.

 

Using SCCs does not remove responsibility. Companies must still ensure the foreign recipient can protect data properly.
